Preamble
(1) The Rules and Regulations are a complement to the Statutes to specify their subject matter. Under no circumstances whatsoever there may be a contradiction between them.
(2) The Rules and Regulations, like the Statutes, are adopted by the Congress of the Union Sportive des Polices d’Europe (USPE).
(3) Compliance with the Rules and Regulations is required on the same basis as for the Statutes.
Article R1
The Congress
Besides its powers defined in the Statutes, the Congress is granted the capacity to
1. rule as the last resort on all disciplinary matters, with the exception of decisions taken by the Jury of Appeal during a championship.
2. decide the resolutions taken by the Executive Committee,
3. elect two auditors for two years,
4. modify or complete the Rules and Regulations,
5. decide about modifications of the Competition Rules.
Article R 2
The Executive Committee
(1) Part of the tasks of the Executive Committee is especially to:
6. set the agenda of the Congress,
7. lead and manage the USPE in compliance with the Statutes and the Rules and Regulations,
8. rule as the first resort of appeal on disputes,
9. examine and work on submitted proposals and applications,
10. manage the finances of the USPE and prepare the budget (financial year from 1st January to 31st December),
11. maintain and extend relationships with national and international state authorities, national and international sports federations and organisations of the police and the general international and national sports unions,
12. award the honorary medal of the Union Sportive des Polices d’Europe either on its own initiative or by proposal of a member union,
13. confirm and change the range of sports disciplines practised by the USPE until the final decision by the Congress,
14. provisionally exclude member unions.
(2) The Executive Committee may delegate part of its powers to expert commissions.
(3) The Executive Committee meets at least twice a year. The meetings shall be organised by the member countries.
Article R 3
The President
(1) The President represents the USPE in all deeds of civil life. He is supported by two Vice-Presidents. With the exception of representing the USPE in court, he may delegate tasks to another member of the Executive Committee.
(2) He is responsible for the application of the assignments stipulated by the Statutes, the Rules and Regulations and the decisions of the Executive Committee.
(3) He chairs the Congress and the Executive Committee. He may ex officio participate in any meeting or session of any commission of the USPE.
(4) In the case of a split vote in the Executive Committee, the President has the deciding vote.
(5) He approves expenditure. He leads the delegations of the USPE at competitions or international meetings. He presides opening and closing ceremonies and medal ceremonies at European championships.
(6) He appoints the representatives of the USPE in the different national and international bodies.
Article R 4
The Vice-Presidents
(1) The Vice-Presidents support the President in carrying out his duties.
(2) In the case of absence or prevention of the President one of the Vice-Presidents takes on the duties of the President, the order of succession in representation of the President being determined in Article 8, Paragraph 4, of the Statutes.
Article R 5
The Secretary General
(1) The Secretary General is in charge of implementing the decisions and realisation of the orientations taken by the Congress, the President or the Executive Committee.
(2) He is in charge of the administration and sports of the USPE and the main contact person for the member unions.
(3) He organises and runs the General Secretariat.
(4) He is the permanent contact person for the authorities of the state in which the General Secretariat is located.
(5) On behalf of the President, he convokes the members of the Executive Committee.
(6) He chairs the Technical Commission and directs its work.
He directs his attention especially to the European police championships and to observation and update of the Competition Rules.
(7) He delegates the tasks and competences of the members of the Technical Commission.
(8) He writes up the minutes and reports of the meetings of the Executive Committee, of the Technical Commission, and if necessary, of the other commissions and sends them to all member unions.
(9) He makes up and updates the championship calendar and cares for the championship's organisation.
(10) He coordinates the appointment of the members of the Executive Committee and of the Technical Commission to the championships and informs the member unions about the results of the championships.
(11) He approves, after examination and agreement of the responsible member of the Technical Commission, all European police records which are achieved on occasion of European police championships and keeps the lists of records. He publishes them in appropriate terms, however, at the latest, when on occasion of an European police championship a new championship record has been achieved.
(12) The Secretary General of the USPE or a substitute having been determined by him, chairs the last preparing meeting of each championship.
After having established the accordance of the proposed measures with the Statutes and the Rules and Regulations of the USPE he gives the permission for the opening of the championship.
(13) According to Article 5, Paragraph 2 of the Statutes he examines the applications for affiliation of national police sports associations into the USPE and presents them together with his recommendation to the Executive Committee for decision.
Article R 6
The General Treasurer
(1) The General Treasurer is responsible for the finances of the USPE .
(2) He draws up a budget draft which he submits, after agreement of the Executive Committee, to the Congress. He draws up the financial report for the Executive Committee every year .
(3) He gives his opinion on all proposals concerning new expenditure. He is responsible for income and payments.
(4) He keeps the books in compliance with the laws and regulations of his country. The currency used is the EURO.
(5) The General Treasurer registers all subsidies and donations attributed to the USPE.
Article R 7
The Assessors
(1) The Assessors are responsible for public relations of the USPE.
Their duties include maintenance of contact to national and international sports clubs and sports federations.
(2) Under leadership of the President they are responsible for the search of sources of income, funds and subsidies from other sports clubs and sports federations as well as from other actors of economic life within the legal bounds.
Article R 8
The Auditors
(1) The two Auditors have to be members of a national sports organisation, that itself is a member union of the USPE.
(2) They must not be members of the Executive Committee or any other commission of the USPE.
(3) They have to belong to two different member unions.
(4) They have to carry out a cash audit at least one time every year and to inform the Executive Committee about the results.
(5) The Congress will elect the auditors by a simple majority for a term of two years.
(6) They have to report on the audit at every Congress.
Article R 9
The Technical Commission
(1) The Technical Commission is a permanent commission of the USPE. It consists of the Secretary General as the chairman and eight additional members each responsible for their own sports disciplines attributed to them.
(2) The Secretary General is responsible for the distribution of the responsibilities for the sports disciplines.
(3) Each member of the Technical Commission is responsible for the drafting, updating and supervision of the Competition Rules for the sports disciplines he is in charge of. At the European championships of the disciplines he is in charge of, he is a member of the organising committee and of the appeal jury.
(4) The Technical Commission meets at least twice a year. The meetings shall be organised by the member countries.
(5) At the meetings of the Executive Committee the Technical Commission reports on the European championships held.
In a further report it evaluates sports disciplines and considers the admission of these disciplines to European police championships or if they should be stroked off the programme.
(6) The Secretary General sends the minutes of the sessions of the TC to all member unions of the USPE and to all members of the EC.
Article R 10
The Commissions
(1) The organising committee and the appeal jury are temporary commissions. They are formed newly at each European championship and stop functioning at the end of the championships in question.
(2) In addition the Executive Committee can install further commissions. It decides about subject, composition, role and duration.
Minutes of each commission meeting have to be presented to the Executive Committee.
At least one member of these commissions is supplied by the Executive Committee.
(3) The members of the Disciplinary Commissions, the Medical Commission and the Anti-Doping Commissioner shall sign a confidentiality agreement and shall be obliged to maintain secrecy regarding the facts, files and information disclosed to them during the exercise of their duties.
Article R 10a
The Medical Commission
(1) The Medical Commission forms a standing committee of USPE that is responsible for granting Therapeutic Use Exemptions in compliance with the respective applicable WADA Code.
(2) It shall comprise three medical practitioners from three different USPE member countries.
(3) They shall be elected by the USPE Executive Committee by a simple majority for a term of four years. They may be re-elected twice.
Article R 10b
Anti-Doping Commissioner
(1) The USPE Anti-Doping Commissioner is a permanent position within USPE responsible for providing advice and support in the fight against the doping.
(2) The position is held by a person that shall be elected by the USPE Executive Committee for a term of four years.
The respective person may be re-elected twice.
(3) His/her tasks shall be defined by the Executive Committee in the requirements to be met by the Anti-Doping Commissioner.
Article R10c
Disciplinary Commissions
(1) The Disciplinary Tribunal and the Disciplinary Court of Appeal are permanent bodies set up within USPE for dealing with violations of the Anti-Doping Regulations. Further provisions are stipulated in the USPE Anti-Doping Regulations.
Article R 11
The Delegate of the Member Union
(1) On the occasion of European championships, each participating member union designates one representive delegate.
(2) The delegate is obliged to supply documents or other records to the organising committee and to the appeal jury to prove the status of the competitor if requested.
(3) He has the right to appeal against the decisions concerning his team or himself.
(4) The delegate shall not take part as athlete or any other team official in the championship in question.
Article R 12
Definitions
Article R 12/1: National Sports Organisation
(1) A national police sports organisation of a country means an organisation of an European state which is legally recognised by this country and represents it.
(2) It has to be democratically organised with elected leaders.
(3) Only one national police sports organisation may be member of the USPE.
Article R 12 /2: Competitors
(1) In order to be able to take part in an European championship organised by the USPE, the members of the member unions have to fulfil the following conditions:
(2) They have to satisfy the provisions set out in Article 23 of the Statutes.
(3) The police are a set of all bodies and institutions in charge of maintenance of public law and order (administrative police and crime investigation departments).
(4) Military police, members of the military, members of fire brigades and civil servants that do not belong to the police are excluded from European police championships.
Article R12/3: Officials
All the members of the Executive Committee and the Technical Commission of the USPE have to be active police officers at the date of their election and members of a national organisation acknowledged by the USPE. In the case of retirement the official keeps his mandate until the end of his term of office.
Members of other commissions as well as the Anti-Doping Commissioner do not necessarily have to be serving police officers.
Article R 13
Affiliation of National Sports Organisations
(1) To obtain affiliation to the USPE, national organisations have to send application papers to the Secretary General including:
1. An affiliation request signed by a representative respectively responsible person of the national organisation in question certifying that the organisation which he presides has a legally recognized association form, that the officials are elected and recognized by the institutional authorities of its state. If there are several national police sports organisations in this country the organisation he chairs has to prove that it represents police sports in his country comprehensively.
2. A copy of the Statutes and the Rules and Regulations governing the organisation.
3. The composition of the Executive Committee or equivalent body with an indication of the function the members in question hold in police.
(2) These documents have to be drafted in one of the three official languages of the USPE (German – English – French).
Article R 14
Annual Fees — Registration Fees — Entry Fees
Article R14/1: Annual Fee
(1) According to Article 6 of the Statutes the member unions have to pay the annual fee until January 31 of every year to the General Treasurer of the USPE.
(2) The amount of the fee is fixed by the Congress.
Article R 14/ 2: Registration Fees
(1) A sports organisation's announcement of participation in a European police championship requires payment of a registration fee to the General Treasurer of the USPE. The amount of these registration fees is fixed by the Executive Committee.
(2) These fees have to be paid before the opening of the championship.
(3) A member union not complying with this commitment is excluded from participation.
Article R14/3: Entry Fees
(1) For every participant in an European police championship an entry fee has to be paid to the organising member union.
The amount of this entry fee is fixed by the Executive Committee.
(2) The entry fee has to be paid by the member union participating in the European championships to the organising member union at least four weeks before the championship, still at its opening at the latest.
(3) Participation will be refused to a member organisation having failed to meet this obligation.
Article R 14 / 4: Payment of Fees
A member union that has been registered to an European police championship, has to pay all fees resulting out of this participation. These fees, also in case of later decided non-participation (for example: withdrawal of the registration), have to be paid in any case.
Article R 15
European Championships
(1) The disciplines held in European Police Championships are set out in the Competition Rules.
(2) European Police Championships take place every four years.
(3) An European Police Championship may only be officially organised if
- a minimum of 10 member unions undertake to participate in individual sports
- a minimum of 8 member unions undertake to participate in team competitions.
In order to promote female sport within USPE, in team sports a minimum of four member unions have to take part in an EPC until further notice.
Individual disciplines and weight classes are recognised as EPC competitions only if competitors from at least six member unions take part.
In track and field, athletes from a minimum number of four member unions have to compete in the various disciplines.
In order to promote female sport within USPE, in individual disciplines/weight categories and relays, until further notice a minimum of four female competitors of four different member unions have to take part in an EPC.
The decision about the recognition of individual disciplines and weight classes will is made with a deadline submitted with Form 1a.
(4) The Congress or the Executive Committee, if required, designate the member unions which will organise these championships.
(5) The Secretary General decides about venue and date of the championships in accordance with the member union organising the championships.
(6) The USPE oaths shall be sworn by an athlete, a coach as well as a referee on the occasion of each opening ceremony of a European Police Championship in the respective national language as well as one of the official languages of the USPE.
(7) Each host to a European Police Championship will be required to send photos to the Secretary General for publication in the USPE Magazine and on the USPE Website.
(8) The competent Member of the Technical Commission of the respective Sport Discipline sends a short report related to the testing mission (number of samples, type of samples: urine and/or blood, additional analyzes if the case, Doping Control Laboratory and Sample collection authority). This has to be sent to the anti-doping commissioner.
Article R 16
The Organising Committee
(1) The organising member union forms an organising committee, which composition it decides itself.
The USPE Secretary General and the competent member of the Technical Committee are co-opted members.
(2) The organising committee is responsible for the organisation of the championship.
(3) The members of this committee must not take part as athletes or team officials in the championship in question.
Article R 17
Sports Rules
Apart from the fixed rules written down in the Statutes and the Rules and Regulations of the USPE there are Competition Rules for the organisation of European police championships. These rules are laid down by the Congress. They define the general conditions of the EPC in question.
Article R 18
Organising Expenses
(1) The organising member union is entirely responsible for all the organising expenses of the European championships.
It also provides free board and lodging for the following persons:
- the three members of the Executive Committee,
- the competent member of the Technical Committee,
- one delegate of each member union taking part in the championships (Art.11 Statutes / Delegate).
(2) Subject to the provisions of Article R 14 / 3, the organising member union also provides free board and lodging for competitors, coaches and assistants whose number is fixed by the Competition Rules.
(3) If a meeting of the Executive Committee and/or the Technical Commission coincides with an European championship, board and lodging for the members of these two bodies have to be provided free of charge, too.
Article R 19
The Appeal Jury
(1) The appeal jury is installed at each European Police Championship. It is responsible for all appeals concerning the organisation and the regular course of events of the championship in question.
It is comprised of.
the USPE Secretary General or their appointed deputy as chairperson,
the competent member of the USPE Technical Commission,
two representatives from the host country; if possible, one of them should not be a member of the police, but a sports expert involved in the work of the national or international sports federation covering the respective sport.
In case of a hung decision the vote of the chairperson shall be final.
(2) During preliminary rounds of European Police Championships, the Jury of Appeal shall comprise the following individuals:
the USPE President,
the USPE Secretary General,
the competent member of the USPE Technical Committee.
The decision of the Jury of Appeal is to be taken within one week after submission of the appeal and to be communicated in writing to the countries involved.
(3) All appeals have to be made in writing by the delegate or one of the attendants of the member union in question within less than an hour after the end of the fixing of or the publication of the results unless the respective international sport rules specify different.
(4) The delegate or one of the attendants of the member union has to enclose an appeal fee with the appeal in order for the appeal to be valid.
The deposited sum will be refunded to its owner if the appeal proves to be justified.
If the appeal is rejected the sum deposited is retained by the USPE.
The amount of the appeal fee is fixed by the Executive Committee.
(5) The decision of the respective Jury of Appeal shall be final.
Article R 20
Notification
Notwithstanding the obligations set out in Article R 14, registration for the participation in the championships has to be transmitted in writing to the organising member union by the member union taking part according to formality and before the deadline requested by the organiser.
Article R 21
Medals
(1) Medals are produced as a reward for the European championships.
(2) The model of this medal has been chosen by the Executive Committee. It has to contain the symbol of the USPE, the sports discipline as well as date and venue of the EPC.
(3) In each individual event, the winner gets a gold medal, the second a silver medal and the third a bronze medal.
(4) For all team events, each member of the winning team gets a gold medal, each member of the second team a silver medal, each member of the third team a bronze medal.
(5) In additon to the medals awarded by the USPE the organising member union may also distribute prizes. It should however give prior information to the Secretary General.
(6) These medals are given to competitors during a traditional ceremony presided by the President of the USPE or his representative. This event is to be organised by the organising committee of the championship in question.
(7) The USPE medal of honour is awarded
in recognition of outstanding contributions made by athletes or officials
to individuals who have rendered outstanding services to the cause of European police sports.
Article R 22
European Police Championships Records
(1) European police championships records are established in all those sports disciplines which are recognized by the USPE and in which the establishment of world records is possible.
(2) For a record to be official, the performance has to be at least equal to or above a previous record established under the same conditions for the discipline in question.
(3) The Secretary General keeps a list of the European police records achieved during championships.
(4) An official European police championships record certificate is issued by the USPE.
Article R 23
Penalties
(1) In case of non-payment of the fees, disregard of the Statutes and Rules and Regulations or fault against the honour, the appeal jury, the Executive Committee or the Congress may be lead to sanction a member union or an official.
(2) In case of failure to regulations defined by the USPE or by the national or international federations in question, the appeal jury, the Executive Committee or the Congress may be lead to sanction a competitor.
Article R 24
Appeal Procedures
(1) Every sanctioned member union, every official, every competitor may appeal before the superior appeal body.
(2) The appeal has to be made in writing and enclosed with a fee.
The Rules and Regulation where approved by the USPE Congress 2018. They will enter into force on 1st January 2019.
